Last Updated: October 2023
1. NATURE OF THE SERVICE: DIGITAL BROKERAGE
Martplot operates exclusively as a digital payment brokerage and independent agency. We facilitate the ease of transaction between global digital service providers and the end consumer. By using this site, you acknowledge that Martplot is not a broadcaster, a content creator, or a satellite signal provider. We do not own, manage, or control the digital services (e.g., Netflix, Amazon, or TV streaming platforms) for which we facilitate payments. Our service is strictly limited to providing a secure, local-friendly payment gateway for global digital products.
2. STATUS AS AN AUTHORIZED PAYMENT FACILITATOR
Martplot operates as a legally registered digital agency. We have integrated professional APIs and payment protocols acquired through rigorous verification and approval processes. Our partnerships are focused on transactional integrity.
We ensure that your funds reach the intended service provider securely.
The presence of a service on our platform indicates that we have the technical API capability to process that payment, not that we have evaluated the legal status of that content in every specific territory.
3. ABSOLUTE USER RESPONSIBILITY FOR LEGALITY
The "Right to Access" is a personal responsibility. Martplot provides the means to pay, but the User provides the right to view.
It is a strict condition of using Martplot that the user confirms the following:
You have verified that the service you are paying for is legally permitted in your country of residence (e.g., Uganda).
You are not using this payment service to circumvent local laws or regulations regarding digital broadcasting.
You acknowledge that Martplot does not, and cannot, monitor the legal status of every third-party service in every jurisdiction globally.
4. INDEMNIFICATION AND LIMITATION OF LIABILITY
To the maximum extent permitted by law, Martplot, its directors, and employees shall not be liable for any legal repercussions, fines, or service disruptions arising from the user's choice of digital service.
No Content Monitoring: We do not check if a user is "authorized" by a specific brand to watch their content; we assume that by initiating a payment, the user has already secured the necessary permissions or is acting within the laws of their region.
Zero Liability for Content: If a service provider terminates your account or if a government entity restricts a service, Martplot is not liable for refunds or legal defense.
5. THIRD-PARTY API AND SERVICE VALIDATION
Martplot utilizes industry-standard APIs to connect with global services. These APIs are used to bridge the gap between local payment methods (Mobile Money, etc.) and international digital platforms.
Our acquisition of these APIs involves "Know Your Business" (KYB) approvals.
These approvals confirm Martplot’s status as a legitimate payment processor, separate and distinct from the content delivery itself.
6. GEOGRAPHIC RESTRICTIONS AND VPN USAGE
Martplot does not encourage or discourage the use of VPNs or geo-spoofing tools. However, we explicitly state that:
If a service requires a specific IP address or location to function, it is the user's duty to manage this.
Martplot will not be held responsible if a user pays for a service that is ultimately blocked due to geographic restrictions imposed by the content owner or local ISP.
7. NO WARRANTY OF CONTENT AVAILABILITY
As a broker, Martplot’s "Product" is the Successful Transaction. Once a payment is successfully processed and the digital voucher, credit, or subscription is delivered to the user or the provider’s API, Martplot has fulfilled its contractual obligation.
We do not warrant that the TV service will be "up" 24/7.
We do not warrant that the quality of the stream will meet user expectations.
All content-related grievances must be directed to the primary service provider (e.g., Netflix Support, Amazon Support).
8. AML (ANTI-MONEY LAUNDERING) COMPLIANCE
Martplot maintains a high standard of financial integrity. While we do not police what you watch, we do monitor how you pay. We reserve the right to flag or block transactions that appear fraudulent or violate AML regulations in Uganda or international banking standards.
9. INTELLECTUAL PROPERTY CLARITY
All logos, trademarks, and brand names (e.g., Netflix, Amazon, etc.) displayed on the Martplot website are the property of their respective owners. Their appearance on our site does not imply an exclusive partnership or ownership by Martplot. They are used solely for the purpose of identifying the digital service for which the user is seeking to make a payment.
10. BINDING AGREEMENT
By proceeding with a transaction on Martplot, you waive the right to claim that you were unaware of these terms. You agree that Martplot is a neutral payment facilitator and that you are an informed consumer acting within the laws of your jurisdiction.
11. REFUND, CANCELLATION, AND SERVICE DISRUPTION POLICY
11.1 The "Completed Transaction" Rule
Martplot is a digital brokerage. Our "product" is the successful transfer of value from the User to the Third-Party Service Provider (e.g., Netflix, Amazon, DSTV, etc.).
Finality: Once Martplot has successfully processed your payment and delivered the digital voucher, credit, or confirmation via our API, the transaction is considered complete and non-refundable.
Brokerage Fee: Any fees charged by Martplot for the convenience of the transaction are non-refundable under all circumstances once the payment process has been initiated.
11.2 Government Actions and Regional Restrictions
Uganda and other jurisdictions may, from time to time, impose restrictions on specific digital services, social media platforms, or the internet at large.
No Liability for "Blackouts": Martplot is not responsible for, and will not provide refunds for, service interruptions caused by government mandates, the Uganda Communications Commission (UCC) directives, or ISP-level blocks.
VPN and Workarounds: If a user pays for a service that requires a VPN to function in Uganda, and that VPN is subsequently blocked or the service becomes inaccessible due to "Geo-Fencing," Martplot is not obligated to refund the payment. The user assumes the risk of paying for services that may be subject to regional volatility.
11.3 Third-Party Service Failure
If you have paid for a service (e.g., a 30-day TV subscription) and the service provider (the TV company) goes offline, changes its content, or bans your account:
Your grievance is with the Service Provider, not Martplot.
Martplot does not hold your funds; we pass them to the provider. Therefore, we cannot "claw back" money for a service that you find unsatisfactory or inaccessible.
11.4 Eligibility for Refunds
Refunds will only be considered in the following technical scenarios:
Double-Charging: If our system charges your Mobile Money or Card twice for a single transaction due to a technical glitch on our end.
Failed Delivery: If you paid Martplot, but our API failed to deliver the voucher code or credit to your account within 48 hours, and we cannot rectify the delivery.
Incorrect Amount: If the amount debited significantly exceeds the quoted price of the service at the time of checkout.
11.5 Non-Refundable Scenarios
We will not issue refunds for:
Customer error (e.g., sending payment to the wrong account number or buying the wrong package). Change of mind after the digital code has been revealed or credit applied.
Compatibility issues (e.g., your device does not support the app of the service you paid for). Unauthorized Use: If you pay for a service that is later deemed "unauthorized" by local authorities, Martplot will not refund the transaction as the responsibility for checking legality rests with the user (See Section 3).
11.6 Refund Procedure
To request a refund under the eligible criteria (Section 11.4), users must:
Send us an email to our support address within 24 hours of the transaction.
Provide a transaction ID, phone number/email used, and a screenshot of the payment confirmation.
Approved refunds will be processed back to the original payment method within 7–14 business days, minus any third-party transaction taxes or mobile money withdrawal fees.
12. ETHICAL USE, ANTI-PIRACY, AND GLOBAL COMPLIANCE POLICY
12.1 Strict Condemnation of Illegal Streaming
Martplot maintains a zero-tolerance policy regarding the use of our payment systems to facilitate illegal streaming, copyright infringement, or the unauthorized distribution of digital content. We strictly condemn the use of "pirated" or "unlicensed" services. Our platform is designed solely to provide legitimate payment solutions for recognized global digital brands and authorized service providers.
12.2 Limitation of Global Legal Monitoring
As a digital brokerage operating across multiple international borders, Martplot facilitates payments for a vast array of global services.
The Complexity of Global Law: Laws regarding digital broadcasting, licensing, and "authorized services" vary significantly from one country to another and are subject to frequent change. No Monitoring Obligation: It is technically and logistically impossible for Martplot to track, interpret, or enforce the specific telecommunications and broadcasting laws of every individual country (including Uganda) in real-time.
Neutral Facilitation: Consequently, the inclusion of a payment API on our platform does not constitute a legal "stamp of approval" for that service in your specific territory.
12.3 User Warranty and Prohibited Actions
By using Martplot, you hereby warrant and represent that you will not use our payment gateway to fund or access any service that has been deemed illegal, unauthorized, or unlicensed by your local regulatory authorities (e.g., the Uganda Communications Commission or equivalent bodies). If you proceed to pay for a service that is found to be illegal in your jurisdiction: Total Personal Liability: You accept full and exclusive legal, civil, and criminal liability for such actions.
Indemnification of Martplot: You agree to indemnify and hold Martplot harmless against any claims, investigations, or legal actions brought by third parties or government agencies resulting from your choice of service.
No Recourse: You waive any right to claim that Martplot "misled" you into believing a service was authorized simply because a payment option was available.
12.4 The "Authorized Access" Mandate
Martplot provides "The Key" (the payment); it is your responsibility to ensure you are standing before a "Legal Door."
Notice to Users: We have provided you with easy, streamlined access to pay for the services you enjoy. However, the burden of verification is yours. You must ensure—prior to clicking 'Pay'—that the service you are subscribing to is officially authorized for consumption in your current location.
